Italian commercial agency law often has to be applied before German courts if Italian law has been agreed in commercial agency contracts. Articles 1742 to 1753 of the Italian Civil Code, the Codice Civile, regulate commercial agency law. In addition, Italian collective agreements for commercial agents and the European Commercial Agent Directive as well as the case law of the ECJ must be observed.
Sales representatives and entrepreneurs often face each other because of disputed commission, compensation and damage claims. We are also dealing with the following scenario: The German customer of an Italian company offsets claims that the commercial agent has assigned to him against the Italian company's purchase price claims. The commercial agent should actually have asserted these claims against the Italian entrepreneur before an Italian court.
